Resentencing

Kimonti Carter’s resentencing hearing will be held at 1:30 p.m. Friday, July 8, at Pierce County Superior Court in Tacoma, Washington, before the Hon. Stanley J. Rumbaugh.

At the hearing, Kimonti will ask the judge to resentence him to “time served” — the 25 years that he has been imprisoned already — which would allow him to be released immediately.

Kimonti’s previous sentence was vacated after the Washington Supreme Court held that mandatory life without the possibility of parole sentences are unconstitutional for youth ages 18 to 21, not just youth under age 18.

Because Kimonti was 18 years old at the time of his crime, the resentencing judge must consider Kimonti’s age and the mitigating qualities of his youth, including his capacity for rehabilitation and change. The judge will also consider information provided by the Pierce County Prosecuting Attorney’s Office, Kimonti, and the community.
